IHC Allows CDA Crackdown on Illegal Guest Houses, Hostels in Islamabad

ISLAMABAD: The Islamabad High Court (IHC) has cleared the way for the Capital Development Authority (CDA) to continue its crackdown against illegal guest houses and hostels operating in residential sectors of the federal capital.

The development came during hearings related to petitions filed against the CDA’s enforcement operation targeting properties allegedly involved in unauthorized commercial activities in residential areas.

According to court orders, two petitions were withdrawn by the petitioners, while three others were dismissed over non-prosecution. The court also vacated restraining orders that had earlier stopped the CDA from taking action against illegal hostels and guest houses.

Justice Inaam Ameen Minhas heard the matter. In one of the proceedings, petitioner Atif Imtiaz withdrew his petition against the CDA, after which the court dismissed the case as withdrawn.

During the hearing, CDA’s counsel Barrister Bilal Naseer raised the issue of allegedly fake CDA notices being used to secure stay orders against enforcement actions. He informed the court that certain individuals had relied on forged notifications to avoid action against illegal hostels operating in violation of zoning regulations.

Following the revelations, the Islamabad High Court Bar Association also hinted at disciplinary and legal action against those involved. Secretary IHC Bar Association Manzoor Ahmad Jajja stated that strict action would be taken if any wrongdoing was established.

Meanwhile, CDA sources said the authority has accelerated its operation against non-conforming use of residential buildings across Islamabad. Notices have reportedly been issued to several guest house and hostel owners, directing them to cease operations within seven days.

Officials warned that failure to comply could result in sealing of premises, cancellation of allotments and registration of criminal cases.The CDA Building and Housing Control Wing maintains that operating commercial hostels and guest houses in residential sectors violates zoning and building regulations. Authorities say the ongoing operation is intended to preserve the original residential status of sectors and curb increasing commercialization in the city.According to officials, a city-wide survey has already been completed and lists of properties violating zoning rules have been prepared.

Enforcement operations are expected to continue in phases across Islamabad.The CDA has also advised citizens to avoid booking accommodation in illegally operating hostels and guest houses, warning that legal complications may arise for those associated with such properties.
