Federal Order Establishes 11-Member KP Advisory Council

The Cabinet Division has issued an order authorising Governor Faisal Karim Kundi to exercise provincial government functions on behalf of the federal government, with assistance from an 11-member Advisory Council. The directive takes immediate effect.

ISLAMABAD, October 11, 2026: The federal government has issued a formal order outlining new administrative arrangements for Khyber Pakhtunkhwa following the proclamation of emergency under Articles 232 and 234 of the Constitution of Pakistan.

The Cabinet Division issued Federal Government Order No. 1/2026, dated October 11, 2026, specifying the transfer of provincial government functions to the Governor and establishing an 11-member Advisory Council to assist in the administration of the province.

According to the order, the federal government has exercised powers conferred under Article 232(2)(c) of the Constitution, following the constitutional proclamation issued earlier the same day.

The document states that the proclamation was issued after determining that the government of Khyber Pakhtunkhwa could not be carried on in accordance with the provisions of the Constitution.

Governor to Exercise Provincial Government Functions

Under the federal order, Governor Khyber Pakhtunkhwa Faisal Karim Kundi will exercise the functions of the provincial government on behalf of the federal government.

The notification further specifies that the Governor will be aided and assisted by an Advisory Council in carrying out his responsibilities under the constitutional proclamation.

This arrangement establishes the administrative framework through which the Governor will exercise the provincial government’s executive functions during the emergency.

Eleven-Member Advisory Council Appointed

The federal government has appointed the following eleven individuals to the Advisory Council for Khyber Pakhtunkhwa:

  1. Tariq Mehmood Pasha
  2. Dr. Amir Abdullah
  3. Lt. Gen. (Retd.) Nigar Johar
  4. Samar Bilour
  5. Dr. Sarfraz Ali
  6. Amir Javed
  7. Dr. M. Irshad
  8. Kifayat Ullah
  9. Tayyab Qureshi
  10. Osman Saif Ullah Khan
  11. Asif Rafiq

The council will assist the Governor in discharging the functions assigned under the federal order.

The notification does not specify individual portfolios or separate administrative responsibilities for the appointed council members.

Sana Ullah Appointed Advocate General

In another administrative decision, the federal government has appointed Sana Ullah, Advocate, as the Advocate General of Khyber Pakhtunkhwa.

The appointment is included in the same federal order establishing the province’s new administrative arrangements.

Constitutional and Administrative Framework

The directive provides that the provisions of Chapter 3, Part IV of the Constitution of Pakistan and the Khyber Pakhtunkhwa Government Rules of Business, 1985, will continue to apply, subject to consistency with the October 11 constitutional proclamation and the federal order.

Article 232(2)(c) permits the federal government, while an emergency proclamation is in force, to assume provincial government functions or direct the Governor to exercise them on its behalf, subject to constitutional limitations.

Article 234 separately addresses situations involving a breakdown of the constitutional machinery in a province.

The order establishes the Governor’s executive responsibilities and the role of the Advisory Council but does not separately detail the provincial legislature’s arrangements.

Order Comes Into Immediate Effect

The Cabinet Division has explicitly stated that Federal Government Order No. 1/2026 shall come into force at once.

The directive bears the name of Cabinet Secretary Kamran Ali Afzal and was circulated to federal ministries, constitutional offices, senior government authorities and other concerned institutions.

The administrative order follows the federal cabinet’s recommendation to Prime Minister Shehbaz Sharif to advise President Asif Ali Zardari to invoke constitutional emergency provisions in Khyber Pakhtunkhwa.

The President subsequently approved the advice, with the federal government citing the province’s security and constitutional situation as grounds for its decision.

The issuance of the order formally sets out the mechanism under which provincial executive affairs are to be conducted by the Governor with the assistance of the newly constituted Advisory Council.
